PRIVILEGES AND BENEFITS - TERMS AND CONDITIONS

These terms and conditions govern and shall be applicable to the benefits and privileges awarded and/or offered by AirAsia Berhad (“AirAsia”) and/or via the BIG Loyalty Program operated by AirAsia’s indirect subsidiary and loyalty program partner, BIGLIFESdn Bhd (“BIG”) in respect of the AirAsia debit card (“AirAsia Debit Card”) and the AirAsia Platinum credit card (“AirAsia Credit Card”), (singularly referred to as “Card” and collectively “Cards”)issued and powered by PermataBank in collaboration with AirAsia.

“Cardholder”, “you” or, “your” refers to you, the individual who has personally applied for and has been issued the AirAsia Debit Card and/or the AirAsia Credit Card by PermataBank.

A. AIRASIA BENEFITS AND PRIVILEGES

1.Introductory Free Inflight WiFi

Inflight WiFi is only for the principal cardholder of AirAsia Credit Card only and usage of the Inflight WiFi is subject to AirAsia Wifi’s Terms of Use (which is available at wifi.airasia.com), and fulfilment of the following terms and conditions:

(i) One time use only and strictly subject toavailability and for a limited period only.

(ii)Only accessible by the cardholderafter activation of the AirAsia Credit Card (upon linkage of cardholder'sAirAsia CreditCard to his/her BIG Loyalty membership account).

(iii) The AirAsia WiFi 2MB Chats Plan is available on selected AirAsia flightswhich are WiFi enabled and can be used for WhatsApp, WeChat, LINE, Kakao Talk & Viber apps only.

2. Priority Check-in*, Priority Boarding* and Xpress Baggage*

(i) The principal cardholders who have activated theirAirAsia Creditcard are qualified for an instant upgrade to BIG Platinum Membership Status.Principalcardholders of the AirAsia Credit Card with a BIG Platinum Membership Status mustlogin as a BIG Member at www.airasia.com or the AirAsia mobile app to book for flights in order toqualify for Priority Check-in, Priority Boarding, and Xpress Baggageat AirAsia’s operating locations.

(ii)Priority Check-in, Priority Boarding and Xpress Baggage are subject to availability and only available at limited/selected airports.

* IMPORTANT:The Priority Check-in, Priority Boarding and Priority Baggage benefits will not be available immediately when the principalcardholders apply for and/or receive their AirAsia CreditCardand is subject to AirAsia’s confirmation of when these benefits will be made available to cardholders.

B. FREEDOM FLYER STATUS - BIG LOYALTY PROGRAM

1. The principal cardholder of theAirAsiaCredit Card will automatically be qualifiedfor the BIG Platinum Membership Status under the BIG Loyalty Program operated BIGfor the 1st year (from the AirAsia Credit Card approval date) only. The cardholder of the AirAsia Debit Card will be qualifiedfor the BIG Gold Membership Status.

2. To maintain theBIG Platinum Membership Status for the 2ndyear onwards, the AirAsia Credit Cardholders MUST:

(a) reach the minimum spend requirement per year of IDR 12,000,000 annual spend


Or


(b) achieve the required qualifying flown sectors pursuant to the BIG Loyalty Program membership terms and conditions i.e. having flown twenty-four (24) to forty nine (49) qualifying flow sectors with AirAsia and/or its affiliates within the preceding twelve (12) months.

3. To maintain theBIG Gold Membership Status for the 2nd year onwards, the Debit Cardholders MUST:

(a)have a minimum balance of IDR 500,000 on the 12th month, every year

(b) achieve the required qualifying flown sectors pursuant to the BIG Loyalty Program membership terms and conditions i.e. having flown fourteen (14) to twenty-three (23) qualifying flow sectors with AirAsia and/or its affiliates within the preceding twelve (12) months.

The benefits above shall apply unless new AirAsia co-brand credit cards and/or debit cards are launched and have a different customer value proposition as determined by AirAsia and PermataBank.

4. The cardholder’s membership status of the BIG Loyalty Program shall be reviewed for re-qualification for Platinum and Gold status respectively through Freedom Flyer membership tiers based on the anniversary month pursuant to the date of issuance of the AirAsia Debit Card and/or Credit Card to the respective cardholders.

1. In order to earn BIG Points (under the BIG Loyalty Program) for your AirAsia CreditCard and/or AirAsiaDebitCard spend, cardholders must first register as a BIG Members under the BIG Loyalty Program and have a valid BIG Loyalty membership account. If you are an existing BIG Member, once your application has been approved, you will receive an email notification from AirAsia as a confirmation that your BIG Loyalty account is already linked to your AirAsia Debit Card and/or AirAsia Credit Card. If you are not an existing AirAsia BIG Member, once your application has been approved, you will receive an email notification from AirAsia as a confirmation of your BIG Loyalty membership registrationand linkage of your BIG Loyalty account with your AirAsia Debit Card and/or AirAsia Credit Card. You mayclick on the link provided by AirAsia to set up password for your new BIG Loyalty account.

2. All retail purchases of principal and supplementary Cardholders will earn BIG Points for spend transactions on your AirAsia Debit Card and/or AirAsia Credit Card, except for instalment purchases.

3. The issuance of BIG Points to the Cardholder’s BIG Loyalty Membership account for spend transactions on the AirAsia DebitCard and/or AirAsia Credit Card (including the management of the Cardholder’s BIG Member ID and management of the Cardholder’s BIGLoyalty Membership account) is operated by BIG and is subject to the terms and conditions of the BIG Loyalty Program, including any additional terms and conditional that may be imposed by BIG from time to time. The BIG membership terms and conditions are available on www.airasiabig.com or on the BIG Loyalty mobile app.

4. Effective 1st June 2019, BIG Points earned from 1st June 2019 will remain valid for a period of twenty-four (24) months from the date of issuance of such BIG Points in the BIG Member’s account and it will automatically expire and forfeited from the BIG Member’s account at the end of 24th consecutive month thereafter.

5. In addition, any BIG Points earned and/or issued in the BIG Member’s account including the balance BIG Points remaining therein up to 31st May 2019 will remain valid for a period of thirty-six (36) months from the date of issuance of such BIG Points and it will automatically expire and forfeited from the BIG member’s account at the end of 36th consecutive month thereafter.

6. BIG Points earned from spend by the Cardholder on his/her AirAsia DebitCard and/or AirAsia Credit Card will be transferred by PermataBank to BIGfor crediting to the cardholder’s BIG Loyalty Membership account every billing cycle. To check your accumulated number of BIG Points, you can log on to www.airasiabig.com or view it on the BIG Loyalty mobile app.

7. To redeem your BIG Points for AirAsia flightsand other lifestyle deals, you must log on to your BIG Loyalty Membership account at www.airasiabig.com or redeem via the BIG Loyalty mobile app. Theredemption of BIG Points is subject to the redemption rules as determined by BIG in accordance with the terms and conditions of the BIG Loyalty Program.

9. BIG Points are not transferable to any other card issued by PermataBank. You cannot combine your BIG Points earned on your AirAsia Debit Card and/or AirAsia Credit Card with the points earned on your other PermataBank credit cards.

10. BIG Points cannot be exchanged for cash or redeemed as rebate or credit to your AirAsia Debit Card and/or AirAsia Credit Card.

11. AirAsia and BIG shall bear no responsibility and shall not be liable for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the Cardholders in connection with or arising from the consumption or acquisition of a product or service acquired through the BIG Loyalty Program or in respect of the earning of BIG Points.

D. General Terms and Conditions

1. The Priority Check-in, Priority Boarding and Xpress Baggage benefits are subject to AirAsia’s confirmation of when these benefits will be made available to Cardholders. Accordingly, AirAsia disclaims all liability in respect of any disputes or claims including any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the Cardholders in connection with the unavailability of the same.

2. By activating or using the AirAsia Debit Card and/or AirAsia Credit Card, Cardholders are deemed to agree to be bound by and subjected to the AirAsia Privileges and Benefits Terms and Conditions and any additional terms and conditions stipulated by AirAsia (including the terms and conditions stipulated by BIGin respect of the BIG Loyalty Program) from time to time. These Terms and Conditions shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the AirAsia Privileges and Benefits. AirAsia reserves the absolute right to vary, delete or incorporate any additions to these Terms and Conditions (wholly or in part) from time to time without any prior notice to cardholders.

3. AirAsia reserves the right to vary, revise, amend, impose, substitute, add and/or change any of the Terms and Conditions applicable to the AirAsia Privileges and Benefits without prior notice to cardholders. The revised and/or new Terms and Conditions will take effect immediately upon the same being posted on www.airasiacards.com (“Website”). AirAsia may issue a notice to cardholders concerning any new or revised terms and conditions, but shall it shall not be mandatory for AirAsia to issue such notices and the same shall be at AirAsia’s sole discretion. Accordingly, notwithstanding the above, advance and prior notice of any changes to the Terms and Conditions applicable to the AirAsia Privileges and Benefits may not be given especially of it is deemed necessary to make any such change immediately. The latest version of the Terms and Conditions will be on the Website. We advise you to check the Terms and Conditions regularly whenever you visit the Website to ensure that you have seen it and are aware of our latest or updated terms and conditions in relation to the AirAsia Privileges and Benefits.

4. The retention or use of your AirAsia Debit Card and/or AirAsia Credit Card after the effective date of any variation, amendment, revision, substitution or change to the AirAsia Privileges and Benefits Terms and Conditions shall be deemed to constitute your acceptance of such variation, revision or change without reservation by you. If you do not accept the proposed variation, amendment, revision, substitution or change, you are entitled to terminate the use of your AirAsia Debit Card and/or AirAsia CreditCard by contacting PermataBank, and the provisions relating to termination in accordance with Permata Bank’s terms and conditions shall apply.

5. Notwithstanding the above, AirAsia reserves its absolute right to suspend, withdraw, cancel or terminate the AirAsia Privileges and Benefits (in whole or in part or any feature or benefit in relation thereto) without reason and/or any prior notice to the Cardholders. For the avoidance of doubt, withdrawal, cancellation, termination or suspension of the AirAsia Privileges and Benefits by AirAsia shall not entitle the cardholders to any claim against or compensation from AirAsia or PermataBank for any losses,damages, costs or expenses suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

6. The AirAsia Privileges and Benefits stated herein may not applicable with any other on-going AirAsia offers, privileges, benefits, campaigns or promotions offered and/or operated solely by AirAsia or in conjunction with any of its partners, including other co-brand partners.

7. All flight bookings made on AirAsia’s website, www.airasia.com shall be subject to AirAsia’s additional terms and conditions as stated therein including AirAsia’s terms and conditions of carriage.

8. The decisions of AirAsia, PermataBank and/or BIGin relation to every aspect of the AirAsia Privileges and Benefits shall be deemed final and conclusive under all circumstance and no complaint or dissatisfaction from any cardholders will be entertained. AirAsia’s (or PermataBank and/or BIG’s, where applicable) decisions in relation to all aspects of the AirAsia Privileges and Benefits is final, binding and conclusive under all circumstances.

9. AirAsia and BIG shall bear no responsibility for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the cardholders in connection with AirAsia Privileges and Benefits.

10. Any rewards, special offers, waivers, benefits or privileges offered or awarded by PermataBank to cardholders in respect of the AirAsia DebitCardand/or AirAsia Credit Card (including but not limited to the Welcome Gift, waiver of annual fees, award of BIG Points by PermataBank and so on) are strictly subject to PermataBank’s Terms and Conditions and any other applicable terms and conditions that may be applicable from time to time. AirAsia and BIGassume no responsibility and disclaim all liability in respect of such rewards, special offers, waivers, benefits or privileges offered or awarded by PermataBank to cardholders, and shall not be responsible or liable for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the cardholders in connection with the same.

11. In the event of any inconsistency, conflict, ambiguity or discrepancy between the English version and any other languages of these Terms and Conditions, the English version shall prevail at all times.

12. These Terms and Conditions are governed by the laws of Indonesia.
